A well-substantiated investigation report can serve as evidence in such a case. The choice for a civil route depends on whether the counterparty is known and able to pay.

What are civil proceedings?

Civil proceedings are a legal case between parties, for example to reclaim a sum of money or recover damages. Unlike criminal law, where the prosecution service brings the case, here you pursue the matter yourself through a lawyer. The court assesses the evidence both parties put forward.

What role does evidence play in civil proceedings?

In civil proceedings much depends on the burden of proof: you must make plausible what happened. A clear report that reconstructs the money flow on the blockchain can be decisive here. An independent expert can explain the findings so the court can weigh them.

Can you start civil proceedings without a known counterparty?

Bringing a claim requires a party that can be addressed. As long as only addresses are known, that party is missing. Your lawyer can assess whether intermediate steps exist that lead to one.

Do you need a police report for civil proceedings?

It is not compulsory, but in practice it is often sensible. Both tracks can run alongside each other, and the criminal route sometimes produces information that is useful in a civil case.

What role does an investigation report play in proceedings?

It supplies the factual substantiation of the money flow. The legal assessment stays with the court, which has to be able to follow the steps in the report.

What a civil route asks of your file

A civil claim shifts the burden onto you in a way a criminal report does not. You have to name a party, establish what they did, and quantify what it cost, and each of those has to rest on material that a court can examine. In crypto matters the first element is usually the hardest, because a route ends at an address rather than at a person, and an address only becomes a party once a provider or an authority connects it to a customer. Where that link cannot be made, a claim has nowhere to land, however clear the route itself is.

The second element is where a good report earns its keep. Amounts, dates and destinations can be stated with references that the other side can verify, which removes the argument about what happened and leaves only the argument about what it means. Quantification is a separate exercise again: the value at the moment of the transfer, the value on the day of the claim and any costs incurred are three different figures, and mixing them is the fastest way to lose credibility. We set them out separately, with the source of each, and we mark what remains uncertain rather than rounding it away.

There is also a timing question that gets overlooked. Preservation of assets, if it is available at all, only helps while there is something left to preserve, so the technical work and the legal step often have to run in parallel rather than one after the other. Waiting until a route has been fully mapped can cost the very thing the claim is about.

External sourceThe Netherlands judiciary explains how claims for damages and liability are dealt with and what has to be substantiated in them, including how the facts are assessed.
